Our Terms & Conditions of Sale

 

The sale of books and other products (goods) we are offering on this website are subject to these Terms & Conditions of Sale as well as our privacy policy.

In order to purchase goods from this website you must be over 18 years of age and possess a PayPal account. We retain the right to refuse any sale which do not meet these or any other of our terms and conditions of sale.

The goods we are offering for sale on this website are printed goods only.

These Terms & Conditions of Sale may be updated or amended by us at any time. All such changes will be effective when posted on this website and by placing an order for goods on this website you agree to be bound by the most current version.

  1. CONTRACT OF SALE
    1.1 The contract of sale for goods offered on this website is between you and Thames & Hudson Australia PTY Ltd. All sales orders will be processed and fulfilled by our distributor in Australia, Alliance Distribution Services (ADS), 9 Pioneer Ave, Tuggerah, NSW, 2259.
    1.2 When you place an order and payment is received, you will receive an e-mail confirming receipt of your order. This email also brings into existence a legally binding contract between us on these Terms & Conditions of Sale subject to the availability of goods as set out in clause 3 below.
    1.3 We must receive payment for the goods for your order to be accepted and dispatched. Any information sent out by ADS with orders refers to their own terms and conditions of sale, but these do not apply to the contract of sale between you and Thames & Hudson.
    1.4 We are entitled to cancel any contract of sale in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by email.
  2. PRICES
    2.1 All prices for goods offered for sale on this website are in Australian Dollars and include GST, where applicable, but do not include delivery charges. Details of our delivery charges will be clearly indicated through the ordering process before payment is confirmed, and will be itemised separately at the point of payment.
    2.2 All prices advertised on this website are subject to change at our sole discretion. The price of the goods you order is the applicable price at the time your order is placed.
    2.3 From time to time we may make special offers available to you. These are available for the limited periods specified in the offer only.
  3. AVAILABILITY
    3.1 The sale of all goods is subject to availability. In the event that after check-out, but before the goods have been dispatched, the goods you have ordered are no longer available, we will advise you by email and give you the option to cancel your order or such part relating to the unavailable goods.
    3.2 If it is not possible to fulfil all or part of your order, we will reimburse the corresponding sum debited from your PayPal account. The refund will be made as soon as possible and, in any event, no later than 14 calendar days from the date of your order. Where these goods form part of a larger order, we will process and dispatch the available goods to you in the normal manner in accordance with these Terms & Conditions of Sale and the refund will be in respect of only the goods we are unable to deliver.
    3.3 Where you elect to accept later delivery of the balance of your order, we will not levy separate delivery charges when we effect delivery.
    3.4 We do not accept liability for our failure to deliver goods to you due to any cause or event beyond our reasonable control.
  4. PAYMENT
    4.1 Payment must be made via a valid PayPal account.
    4.2 Payment is taken at the point of purchase of the goods. Once payment has been received and we have received confirmation of this from PayPal, PayPal will confirm your order by sending you an email at the email address you provided when ordering.
    4.3 All prices and delivery charges are in Australian Dollars. Paypal will perform any currency conversion if necessary.
  5. DELIVERY
    6.1 We can deliver to any address in Australia.
    6.2 There may be a charge for delivery. This will be advised on the site and during the purchase process if applicable.
    6.3 Any delivery times are estimates only and, while we will endeavour to avoid delay, we will not be liable to you for any loss or damage arising from delay in delivery.
    6.4 We may deliver the goods in instalments, but the delivery charges will be those notified to you at the time you place your order.
    6.5 If you receive the wrong goods or the goods you receive are damaged in transit or defective, please refer to the terms and conditions of our Returns and Cancellation Policy, detailed in point 7 below. 

7. RETURNS, CANCELLATION, GOODS DAMAGED IN TRANSIT, DEFECTIVE GOODS

7.1. We will accept the return of goods that arrive damaged or defective or if your goods do not match your order.
7.2. If the goods you have ordered are damaged in transit or not what you ordered please email us at enquiries@thaust.com.au within 7 calendar days providing as much detail as possible as to the reasons for your return. We will endeavour to process your query within 4 working days and contact you via email about its status. We will supply you with replacement goods or provide you with a refund within 14 calendar days.
7.3. If you find that the goods are defective please email us at enquiries@thaust.com.au within 30 calendar days providing as much detail as possible.  We will endeavour to process your query within 4 working days and contact you via email about its status.
7.4. If you change your mind about your order after the goods are dispatched to you, you may return them to us, at your cost and risk, within 7 calendar days of receipt. Please email us at enquiries@thaust.com.au.  Please provide as much detail as possible. We will endeavour to process your query within 3 working days and contact you via email about its status. Provided that goods that are sold shrinkwrapped are returned with the shrinkwrap intact or non-shrinkwrapped goods are returned in re-saleable condition, we will refund their cost, but not the delivery charges, within 14 calendar days.
7.5. If you change your mind about your order before the goods are dispatched, please email us at enquiries@thaust.com.au . Please provide as much detail as possible. We will endeavour to process your query within 4 working days and contact you via email about its status. In the event that payment has been taken, we will refund this to you within 14 calendar days.

    8.1. While PayPal use appropriate encrypted security software on this website, the security of any payments transmitted and processed via the Internet cannot be guaranteed.
    8.2 We do not accept liability for any losses you may incur or sustain as a result of transmitting information by means of e-mail or any other internet link.
